Terms of Use

Please read these Terms of Use ("Terms") carefully before using the MagicRestore mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

MagicRestore provides AI-powered photo restoration services. The App allows you to:

• Upload photos for AI-powered processing
• Restore and enhance old, damaged, or low-quality photos
• Colorize black and white photos using artificial intelligence
• Upscale images to higher resolutions
• Download and share restored photos

3. AI Technology Disclaimer

Important Notice About AI-Generated Results

This App uses artificial intelligence (AI) and machine learning technologies to process and restore photos. Please be aware of the following:

3.1 Results May Vary

• AI-generated results are based on algorithmic predictions and may not always be accurate or meet your expectations.
• The quality of restoration depends on various factors including the original image quality, damage extent, and lighting conditions.
• AI may interpret and reconstruct missing or damaged portions of images based on patterns, which may not reflect the original content.
• Colors added to black and white photos are AI predictions and may not represent the actual historical colors.

3.2 No Guarantee of Accuracy

We do not guarantee that AI-processed images will be:

• Historically accurate or factually correct
• Identical to the original undamaged photo
• Suitable for any particular purpose, including legal, archival, or evidentiary use
• Free from artifacts, distortions, or unintended alterations

3.3 Human Review Recommended

We recommend reviewing all AI-processed images before using them for important purposes. AI results should be considered as suggestions or enhancements, not definitive restorations.

4. Responsible Use of AI Features

User Responsibility

You are responsible for using the AI features of this App ethically and lawfully.

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. Acceptable uses include:

• Restoring personal and family photos
• Enhancing photos you own or have permission to edit
• Creating improved versions of your own images for personal use
• Legitimate professional restoration work with proper authorization

4.2 Prohibited Uses

You agree NOT to use the App to:

• Create, distribute, or share misleading, deceptive, or fraudulent images
• Generate deepfakes or manipulated media intended to deceive others
• Process images that violate others' privacy, intellectual property, or publicity rights
• Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Process images containing illegal content, including child exploitation material
• Misrepresent AI-enhanced images as original, unaltered photographs
• Use restored images for fraud, forgery, or to create false evidence
• Circumvent or attempt to circumvent any security features of the App
• Use the App in any way that could damage, disable, or impair our services

4.3 Content Responsibility

You are solely responsible for:

• Ensuring you have the right to process any images you upload
• The content you create using our AI features
• How you use, share, or distribute AI-processed images
• Disclosing when images have been AI-enhanced, where appropriate or required

5. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device for your personal, non-commercial use.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any unlawful purpose
• Remove any proprietary notices from the App
• Use automated systems to access or interact with the App

6. User Content

You retain all ownership rights to the photos you upload to the App ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, store temporarily, and transmit your content solely for the purpose of providing the App's services.

You represent and warrant that:

• You own or have the necessary rights to the photos you upload
• Your use of the App does not violate any third party's rights
• Your content does not violate any applicable laws

7. Subscriptions and Payments

7.1 Subscription Plans

The App offers subscription plans that provide access to premium features. Subscription options and pricing are displayed within the App.

7.2 Billing

All payments are processed through Apple's App Store. By subscribing, you agree to pay the applicable subscription fees. You are responsible for all charges incurred under your account.

7.3 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price you were originally charged.

7.4 Managing Subscriptions

You can manage your subscription and turn off auto-renewal at any time through your Apple ID account settings. To cancel, go to Settings > [Your Name] > Subscriptions on your device.

7.5 Cancellation

If you cancel your subscription, you will continue to have access to premium features until the end of your current billing period. No refunds will be provided for any unused portion of a subscription period.

8. Intellectual Property

The App, including its design, features, AI technology, and content (excluding User Content), is owned by us and protected by intellectual property laws. Our trademarks, service marks, and logos may not be used without our prior written consent.

9. Disclaimer of Warranties

THE APP AND ALL AI-GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI RESULTS.

WE DO NOT WARRANT THAT:

• The App will meet your requirements or expectations
• AI results will be accurate, reliable, or error-free
• The App will be uninterrupted, timely, secure, or free of viruses
• Any errors in the App will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Damages arising from reliance on AI-generated results
• Damages resulting from unauthorized access to your data
• Any other intangible losses

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless MagicRestore and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App or AI features
• Your violation of these Terms
• Your violation of any third party's rights
• Content you upload or create using the App

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms or engage in prohibited uses. Upon termination, your right to use the App will cease immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of the App after changes are posted indicates your acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
